Building regulations appeal
It is possible to appeal against building regulations decisions if:
- The applicant considers the project should not have to comply with building regulations.
- The project is refused building regulations approval and the applicant believes the decision is unfair.
If the applicant wishes one or more aspects of the building regulations to be ignored or relaxed, they must first ask the local authority (rather than a private building control body). If the local authority disagrees, the applicant has one month to appeal to the Secretary of State.
The procedure for making appeals about different aspects of the building regulations is set out here: https://www.gov.uk/guidance/building-regulations-appeals--6
If the project is refused building regulations approval (by a local authority or private building control body), the applicant can ask the Secretary of State to make a determination.
The procedure for asking for a determination about different aspect of the building regulations is set out here: https://www.gov.uk/guidance/building-regulations-determinations
